Limited Warranty
Magnasphere Corporation (“Magnasphere”) warrants, to the installing dealer, its commercial security sensors listed below (each, a “sensor”) to be free from defects in workmanship and materials when purchased new for so long as such sensor is properly installed and used, normal wear and tear, alteration, accident, abuse, misuse, faulty installation and damage during shipping excepted:
Commercial sensor, C series (Concealed) All Model nos.
Commercial sensor, S series (Surface mount) All Model nos.
Commercial sensor, 300C and 300S series. All Model nos.
Magnasphere’s obligation under this warranty, and the installing dealer’s sole and exclusive remedy, is limited to the following: (a) replacement of the sensor. This warranty is made to the installing dealer and is not assignable.
To obtain service under this warranty, the installing dealer must call Magnasphere at 262-347-0711, to obtain a return authorization, and return the product together with a dated proof of purchase receipt to: Magnasphere, 2556 Southside Park Dr. Goshen, IN 46526.
Upon receipt of the returned sensor and verification of proof of purchase, Magnasphere, if it determines, in its sole discretion, that the defect is not due to normal wear and tear, alteration, accident, abuse, misuse, faulty installation or damage during shipping, will replace and return, the sensor to the installing dealer, at Magnasphere’s expense. Returned sensors shall become the property of Magnasphere.
TO THE EXTENT PERMITTED BY LAW, MAGNASPHERE HEREBY DISCLAIMS ALL OTHER IMPLIED OR EXPRESS WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY, SUITABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
LIMITATION OF LIABILITY: THIS WARRANTY IS YOUR SOLE AND EXCLUSIVE REMEDY. MAGNASPHERE SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR OTHERWISE, (INCLUDING, WITHOUT LIMITATION, LOST REVENUES, LOSS OF THE USE OF PROPERTY, LOSS OF TIME, AND LOST PROFITS) ARISING OUT OF ANY THEORY OF LIABILITY OR RECOVERY, INCLUDING STATUTORY, CONTRACT OR TORT. ANY CLAIM ARISING OUT OF THE PURCHASE OR USE OF A SENSOR MUST BE BROUGHT WITHIN ONE (1) YEAR OF THE OCCURRENCE THAT GAVE RISE TO SUCH CLAIM. NOTWITHSTANDING THE TERM OF ANY LIMITED WARRANTY, OR IN THE EVENT THAT ANY LIMITED WARRANTY FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL MAGNASPHERE’S ENTIRE LIABILITY EXCEED THE ORIGINAL PURCHASE PRICE OF SUCH SENSOR, WHICH PURCHASE PRICE WOULD BE PRORATED IF SUCH SENSOR WAS SOLD IN A PACKAGE WITH OTHER SENSORS.
